Boar’s Head hit with yet another class action lawsuit over food safety issues

A group of consumers have filed a class action lawsuit against Boar’s Head Provisions Co. Inc., alleging the company falsely advertised its products as being made in sanitary conditions.

The lawsuit joins multiple other cases pending against the deli meat supplier.

Four plaintiffs filed claims that Boar’s Head engaged in false and misleading advertising by misrepresenting the safety and quality of its food products.

“Boar’s Head has failed to keep its five-generation promise of quality and care,” the Boar’s Head food safety class action says.

The plaintiffs want to represent a California class of consumers who purchased Boar’s Head products from plants in Forrest City, Arkansas; New Castle, Indiana; and Petersburg, Virginia, within the past three years.

The Boar’s Head class action lawsuit points to United States Department of Agriculture inspection reports that allegedly revealed unsanitary conditions at Boar’s Head meatpacking facilities.

The allegations pointed to dirty and meat-caked machinery, rusted and chipping equipment, pools of standing water, and infestations of cockroaches and flies.

The class action lawsuit alleges the company “endangered public health by allowing black mold-like substances to fester in production areas and failing to document critical food safety hazards while continuing to charge consumers a premium for its purportedly high-quality products.”

In addition to violation of state laws, the plaintiffs assert claims for intentional misrepresentation, negligent misrepresentation, breach of express warranty and breach of implied warranty of merchantability.
